What makes a professional negligence claim?
Here are some typical scenarios for professional negligence claims where compensation is awarded:
1. Mishandling your compensation claim
A claim against another firm of solicitors or a barrister if they have mishandled your personal injury compensation claim. For example, your personal injury solicitor has missed a deadline which means you are no longer entitled to compensation. Here, we may be able to make a claim against them for the damages you would have been entitled to if your claim had been handled correctly.
2. Failure to conduct adequate conveyancing searches
A claim against a solicitor if they have failed to carry out the proper searches during conveyancing. For example, Mr Jones bought his house in good faith but his solicitor failed to conduct a coal mining search. When Mr Jones made some excavations in his garden, he discovered the remains of a coal mining shaft. In this case we pursued a successful claim on behalf of his solicitor.
3. ‘Under-settling’ your compensation claim
If your former solicitor has settled your compensation claim for a value which is less than you think your claim was worth, it is possible that we could pursue a claim against them.
