Collaborative Law

We recognise that divorce, separation and other family disputes are often a traumatic experience.  Some cases can benefit from the help and guidance of mediation or the collaborative law process.  This generally involves a series of meetings with a view to reaching a negotiated settlement, whether it is in respect of the finances or the children. 

A settlement in respect of which the parties have input, even if concessions are made, is often far better than having Orders imposed by a Court. 

Collaborative Law is the name given to the co-operative approach between solicitors and clients where all work together to resolve the problems that arise from the breakdown of the relationship.

Collaborative law is a way to resolve divorce and family disputes with respect, dignity and avoiding potential pressure on financial resources, the time of both parties and the emotional cost of more traditional methods in going to court.

The parties and their lawyers confirm their commitment to avoiding the traditional adversarial approach by signing an Agreement.

It is a fundamental term of the Agreement that neither side will resort to an application to the Court.  If either party withdraws from the Collaborative Law process then they must find new legal representation. 

Collaborative Law is a voluntary process which approaches the resolution of disputes constructively and co-operatively by the parties and their lawyers.

Collaborative lawyers have all undertaken specialist training. The goal of Collaborative Law and collaborative strategies is to reach voluntary settlement without the threat or use of the Courts.

The process involves a number of four way meetings between the parties and their lawyers.  An Agenda is set by the parties with advice and assistance from their individual lawyers as to what they want to resolve.

The Collaborative Law approach is not suitable for all parties but it is certainly appealing to many couples as the correct way to resolve their problems.
